BOSTON, MA (FRANKLIN COUNTY NOW) — The Massachusetts Supreme Judicial Court maintained the lower court’s conviction of Joshua Hart in the 2016 Franklin County home invasion murder of an elderly couple.
Hart filed a motion to vacate his conviction, citing issues with the judge’s instructions to the jurors. However, the SJC upheld the conviction.
Thomas Harty and Joanna Fisher were killed and their vehicle stolen by Hart and his codefendant Brittany Smith and used to flee to Virginia. Hart and Smith are serving life sentences.
